The American criminal justice system is comprised of three major institutions which process a case from inception, through trial, to punishment. A case begins with law enforcement officials, who investigate a crime and gather evidence to identify and use against the presumed perpetrator. The case continues with the court system, which weighs the evidence to determine if the defendant is guilty beyond a reasonable doubt. If so, the corrections system will use the means at their disposal, namely incarceration and probation, to punish and correct the behavior of the offender.
Throughout each stage of the process, constitutional protections exist to ensure that the rights of the accused and convicted are respected. These protections balance the need of the criminal justice system to investigate and prosecute criminals with the fundamental rights of the accused (who are presumed innocent).

This week on People Profile we are speaking with Duane Dundas who was charged and subsequently convicted in the double homicide of two children. It is important to note that this interview was done via telephone and the contents of this document is an authentic replica of that conversation.

Thanks for speaking with us on People Profile Duane. How did you arrive in the USA?

Like most legal persons do Dr.C. I had my visitor’s visa and I have been to the USA several times on vacation with my mother and sister. At the time the preferred airline was Air Jamaica.

Give us some background in regards to your upbringing Duane.

Dr C, I was raised in a god fearing, Christian home. I might be the little “rude boy type” sometimes while growing up in Jamaica, but that was just a period in my life living in Harbour View and hanging out with my friends. But I assure you I was no trouble maker or criminal.

What are the circumstances surrounding the case from your perspective?

Here is where it gets tricky sir and I really do hope you have the time to listen. I know that this call will cut of in a couple minutes but if that happens I will call you back.
I left Jamaica August 20th 1990 to visit the US and to see the American dream for myself.
On 7th January 1992 my uncles and I were detained for questioning and was illegally interrogated for hours for a double homicide. We had no knowledge of what had actually happened and we had no idea it was on the news; much less to entertain the idea that we allegedly had an involvement in the crime.
Charges were brought against us that we were involved in a drug deal that had gone bad.
My uncles and I, along with other suspects, were detained for questioning. At that time in the early 1990’s, any and every crime involving narcotics were alleged to have some Jamaican involvement. Since we had no family or community support in the Baltimore region; we were targeted as examples of the infamous Jamaican possess. We were not aware of the extents that the prosecution would have gone to find a culprit for the crime; we were set-up, framed, and unjustly charged by the Baltimore Homicide Department. What were the charges brought against you?

Well the first time they charge me was for gun and drugs. Then after questioning, they changed it to double Homicide of two children (conspiracy).

Wow! What is your sentence?
 
Duane Dundas
2 Life sentences with parole. Doc i cried everyday when i think of the wrong that had been done to me. I prayed night and day that somehow i would wake up from this nightmare i am having.

I can only imagine. Were you a drug dealer?
 
Duane Dundas
Dr.C, I wont even bother to lie to you, yes I used to joggle weed here and there…trying a little hustling, trying to make a thing for myself. I promised you however, I was no criminal. I have never hurt or cause anyone to be hurt in any way shape of form. I am certainly not a murderer and I have no record of criminal activity or gang related stuff here or Jamaica.

I see, are you eligible for parole?

Yes but this system don’t usually give parole especially after what this stupid boy did. 
There is a story of a boy who abused the system. He killed his girlfriend and was paroled based on erroneous information. Because of that the system doesn’t give any more parole.
The parole system is a joke! I lose my confidence in this system.

My family and friends are all trying to seek legal and professional help on a pro bono bases. But as you know Doc it’s very difficult to get help especially in cases such as mine.

What help have you been getting from your lawyers?

What help have i been getting? I am being represented by an attorney who does believes in my innocence and who has subjected me to a lie detector test to further substantiate my claim of innocence. I was asked very clearly and precisely if I was involved in the crime or if any of my uncles were involved in the crime – and I passed this test with no deception. Even though the polygraph is not permissible in court, the fact that I was willing to put my credibility on the line has proven to everyone that I am willing to do whatever it takes to prove me and my uncles’ innocence. The lawyers are trying everything in their powers to assist but due to limited resources its almost impossible. They all knew of my innocence including the police! The police needed a scapegoat and as 3 Jamaican black males they just screwed us.

Wow! How are your family dealing with this issue?

Honestly, my 24 year old daughter got the blunt of my incarceration with me not being in her life to assist in her upbringing and development. Now i have a grandchild and it’s a terrible feeling Sir, a terrible feeling. My wife of 3 years is also struggling to cope….not to mention my mother and sister….Doc it’s very very hard on us all…….

That means your daughter who is now an adult hasn’t seen you much at all!!! What about the innocence project? Any assistance from them?

Again, they are to be included in the list of entities/persons that are trying to assist but with limited resources and time constraints it’s like going against a brick wall. I really would appreciate any help Doc. I am completely innocent Sir, I have never killed anyone and it is wicked that i am wasting my life in prison because of the flaws in the system and the wickedness of some people.

I understand Duane. What is an average day looks like?

Oh Dr.C, you sure you want to hear about that? Wow, not good Sir…I dream of walking the streets everyday Sir…hugging and laughing with my family especially my daughter and grand daughter. Living life to its fullest and just being the person that god had intended me to be. Instead I am being dictated to do whatever I am told to do. The system is awful and I cant even begin to describe how awful and wicked it is. I just live my life one day at a time Sir and that’s the truth. I prayed day and night that this tragedy ends real quick Sir.

What is your biggest request at this time?
 
Duane Dundas
Dr.C my biggest wish is to find people who can represent me in a court of law. This takes time and money that neither me or my family have. So I would say that my biggest request is for financial assistance. My wife,,,has setup a Go Fund Me account and i would appreciate any help.
If there is one thing to take from this talking Sir is that i would like everyone to read on the circumstances of the case and draw their own conclusion. Also i really would like to ask for any, any, any! kind of assistance Sir.
